Act now for your copyright

Act now for your copyright

In the previous design article Prevention Cures Copyright, we covered how to protect your web site files and gather evidence of your copyright ownership. Now we will look at how you can take all of your preparation and use it to find your online thieves.

Use the major search engines

To tell if someone has stolen your web site or your web graphic images, you can use the major search engines.

Start by searching for words or phrases unique to your site, such as your company name. This is where we catch many online thieves. They steal our web content without remembering to take out every instance of our name.

For further quality searches, we recommend typing the article titles and headlines from your most popular web pages into the search box.

For each search, go through the first three results pages. If the content looks familiar, check the web address (URL). If it shows a link to a page you are not familiar with, click on it and review the page.

Make sure you are given full credit for your work that another site displays – especially if another web author has used your work without your permission. If there is no reference on the page to the original author or to your web site, you might have a case for copyright infringement.

Some search engines allow you to do searches for graphic images. You can also search for unique graphic images that you use on your site, particularly if you named your graphic image an unusual name. It can even be a 1 pixel x 1 pixel transparent GIF with an unusual name in an unusual place. Most online thieves are usually not savvy enough to find that image within your HTML documents.

Review your log files

Your log files can be helpful in finding online thieves. These statistical reports are carried by most web hosts and include updated records of who links directly to your web site.

Generally, your web host will provide you with password-protected access to these stats, which you can view online and print out. We recommend that at the end of every month, you print out your stats for that month and look through the list of web sites linking to yours. See which sites look unfamiliar and review those pages individually.

Before contacting anyone – alleged thief, web host, ISP, their partner sites, anyone – gather all evidence of theft first.

Make hard and digital copies of the stolen web page content and the source code. Print the web pages that were stolen and make sure the date is contained on every page you print. Include URL’s and titles. You must have a date on the printed pages and the URL’s in the event the host or the webmaster takes down the site.

Next, view the source code, that is, the HTML code, and print that. You can do this by going to the Menu command and View/Source in your web browser. Compare the code of the offender’s site with your own to see how closely they match. Many online thieves will take HTML code without making any changes ?same font settings, same graphic bullet points, same table formats.

Then make a list of all web pages that have the stolen items and write down what was stolen on each page. List the content and the names of any graphic images which were stolen.

Research the Offender

Conduct a WHOIS search to see who hosts the site and who the administrative contact is.

See if the web host has an Acceptable Use Policy that speaks to copyright infringement. This is more evidence you can use against online thieves. Print the Acceptable Use Policy web page and source code.

Before you contact the offender, notify the following people regarding the theft of your copyrighted material:

1. A solicitor (optional).

2. The offender’s web host.

3. Major newsgroups – in your industry and your offender’s industry. This can be particularly useful if you are a regular contributor and 3rd parties recognize your original work.

4. Major search engines and directories.

It is usually not required to bring in a solicitor to handle the initial stages of a copyright dispute, as most claims are settled early on. However, if the alleged thief’s web site appears to have a substantial business presence, you might wish to consult with a solicitor, preferably one specializing in intellectual property and/or Internet law.

Then request that the stolen web pages and graphic images be removed from the thief’s server.

Once you’ve done all this, speak with the company owner or the manager of the offending web site. If you can’t reach one of them, speak to the webmaster. It is better to make a phone call before sending an email message so you will be more likely to catch them in a lie.

Once online thieves have been discovered, they might try to avoid responsibility, pass blame, and claim that they were merely “testing” their site, or say they were really doing this to help you. Keep them talking but never let them off the hook.

Document and demand removal of copyrighted materials

Immediately after ending your conversation, send a carefully worded email message or a certified, registered letter to the offender explaining the copyright infringement.

Order the removal of all offending material. All you need is a few pages of evidence to send, but you will have to list every graphic image they have used or stolen without your permission before you contact them.

Demand that you receive at least the following:

Agreement to have the copyrighted materials removed. 24 to 48 hours is a reasonable time frame.

A signed notice – or at least an email message – from the offending parties stating they acted with impropriety; that the files have been removed and will stay removed; that no copyrighted materials from your web site will ever be copied by them again under any circumstances (or, at least, without your expressed written consent); and that you will pursue a lawsuit against them if they do not comply with your order or if at any time they are found to be responsible for any damages.

Why is this important? Because now you have acknowledgement of wrongdoing. If these pages ever appear again without your permission, you have the email, letter, and signed notice as evidence.

Pull the Legal Trigger

If the online thieves do not take down the stolen pages and/or graphic images, remove the disputed material to your satisfaction, or agree to your terms within 48 hours, hire a solicitor to send them a registered, certified letter. Make sure the letter is printed on the lawyer’s letterhead.

It is always best to avoid a lawsuit – better to come to some settlement, especially if you’ve suffered no significant losses. Lawsuits can prove costly and time-consuming.

It is not up to you to fight online thieves everywhere. The important thing is to keep you and others informed about what legitimate web site owners can do to protect themselves so they can spend more time running their businesses and less time worrying about who’s stealing their business

biz ops, mlm, newbie
If you want to start your own website but aren’t sure how to go about it, this article will teach you the 5 necessary steps to get your website up and running. Having your own website is THE key element to your online success and the ability and knowledge to customize it will help you become successful in your online endeavors.

As a newbie on the web you probably don’t have a lot of money to get your first site up and running. The good news is that web services today are lower than ever and you can get a site set up and running for about $50. The monthly cost for web hosting is around $6; add in a yearly domain fee of about $10 and you’re ready to roll. Is that cheap enough for you??

Let’s get started…

Step #1: Brainstorm ideas and put them in writing.

Outline your websites structure. Don’t worry about what your site will look like yet, just get the basic structure down and the overall layout. What do you want in your website? At the minimum, you’ll need a main or home page, a product description page, an “About Me” page and most of all an order page.

Once your outline is complete, you’ll need to figure out a way to get that information into your computer. There are lots of resources to help with this step.

“HTML” (Hyper Text Markup Language) is the programming language used for your website. You can hire a web programmer to program your site, but that can be very expensive. You can go buy a book like “HTML for Dummies”, which will teach you how to code your website, but that is a difficult and time consuming task and we want to do things the EASY way. The EASY way is to use a program like MS Frontpage, which is included for FREE nowadays on many new computer systems. Frontpage is a text based system that allows you to type your webpage in plain English and then have it converted to HTML for viewing on the web. With a few hours of practice you can have your website coded and ready to upload.

Step #2: Use a professional website template.

If you utilize a pre-designed template you can have a professional looking website in a matter of minutes. Templates provide the online graphics and overall look and style of your website. A professional pre-designed template can be purchased for under $40 and can save you many hours or even days of design time. If that price is too high there are also many professionally designed FREE web templates available, although they are very basic in style and may not be suitable for your website. Even if you have a small budget, purchasing a professional template is an efficient way to begin.

Step #3: Purchase and register a domain name.

Your ideas are ready and you have adapted them to your professional template, so now it’s time to purchase a domain name for your website. Registering a domain name allows web surfers to view your website by entering (www.yournamehere.com)

You’ll want a catchy domain name that is easy to remember and tells a little bit about your business (ex. LowCostAutoInsurance.com). You’ll need to choose a name registrar such as GoDaddy.com to register your name and if you are having trouble finding a name they even have a domain name suggestion tool that will help. You can register your domain name for less than $10 a year and once it’s registered, that name is yours for as long as you pay the annual renewal fee.

Step #4. Choose a web host.

Your site is ready, your domain name is registered and you’re ready to go, Now What…

You need to hire a company to host your website. There are hundreds, if not thousands of web hosts available and your job is to sort through them and choose the right company. Since your web host is your 24 hour connection to the web, you’ll need to make sure they are very reliable. If your web host has technical difficulties, your website will be invisible to all your customers and you will not be successful. Monthly hosting fees can range from FREE to hundreds of dollars depending on the services you choose. Most beginner websites can be hosted for under $10/month by a quality web host. We recommend this best cheap web hosting provider

Step #5: Upload your website.

Now that you have chosen a web host you need to transfer your new webpage’s from your computer to the computer at your web host so they are visible on the internet. While this may seem like a confusing and technical process, it really is quite simple. One of the easiest transfer processes is to upload your site using “FTP” (File Transfer Protocols). One of the easiest “FTP” programs is CuteFTP, which allows you to drag and drop files from your computer and place them in your web directory at your web host. Take a few minutes to familiarize yourself with your “FTP” program because as a webmaster you will be utilizing it quite frequently.

That’s it. Your site is now up and live on the web. While the process may seem technical and difficult you’ll find that with practice this will become an easy and rewarding experience. Practice with your new tools and you’ll be an expert webmaster in no time.

Best-selling author, designer, and web standards evangelist Jeffrey Zeldman has revisited his classic, industry-shaking guidebook. Updated in collaboration with co-author Ethan Marcotte, this third edition covers improvements and challenges in the changing environment of standards-based design. Written in the same engaging and witty style, making even the most complex information easy to digest, Designing with Web Standards remains your essential guide to creating sites that load faster, reach more users, and cost less to design and maintain. Substantially revised—packed with new ideas How will HTML5, CSS3, and web fonts change your work? Learn new strategies for selling standards Change what “IE6 support” means “Occasionally (very occasionally) you come across an author who makes you think, ‘This guy is smart! And he makes me feel smarter, because now I finally understand this concept.’” — Steve Krug, author of Don’t Make Me Think and Rocket Surgery Made Easy “A web designer without a copy of Designing with Web Standards is like a carpenter without a level. With this third edition, Zeldman continues to be the voice of clarity; explaining the complex in plain English for the rest of us.” — Dan Cederholm, author, Bulletproof Web Design and Handcrafted CSS “Jeffrey Zeldman sits somewhere between ‘guru’ and ‘god’ in this industry—and manages to fold wisdom and wit into a tale about WHAT web standards are, HOW standards-based coding works, and WHY we should care.” — Kelly Goto, author, Web ReDesign 2.0: Workflow that Works “Some books are meant to be read.
Artistic Web Design Using Adobe Dreamweaver and Photoshop: An Introduction Technorati Tags: Adobe, Artistic, design, Dreamweaver, Introduction, Photoshop, Using

This book provides an understanding of the principles of artistic design as they relate to the web, followed by the application of those design principles using Adobe® Dreamweaver and resulting in the ability to create effective websites. Tailored to users of either CS3, CS4, or the latest version of Dreamweaver, CS5, each chapter is comprised of three sections: new concepts; "reinforcing your knowledge" through projects and exercises; and a "build your own website" section designed to offer the reader the opportunity to build their own website using the concepts from each chapter. By the end of the book, the reader will have their very own website! The book starts with an introduction to the principles of design unique to the web, and then progresses to the incorporation of those principles into Adobe Dreamweaver for aesthetically pleasing web design. In fact, several chapters of this four-color, heavily illustrated text are devoted to web design from an artist's perspective. The author discusses understanding the psychological influence of colors, web typography and the voice of type, the principles of design as they relate to the web, and how to maximize the potential of the graphic programs the readers are already familiar with to create effective graphics, creative navigation, and more. This text brings the reader through the design stage from initial concept to graphic preparation, followed by the importing of graphics or whole pages into Dreamweaver for building the site and uploading it to the Internet. Although no programming knowledge is required, a chapter on HTML and other web programming fundamentals is included. A CD-ROM with images, sample web pages, and more accompanies the book. An instructor's resource kit is available upon adoption as a text.

Even if you're short on design skills, with this book you'll be creating your own stunning web sites in no time at all. Throughout, the focus is on simple and practical techniques that anyone can use - you don't need to have gone to art school or have artistic flair to create stunning designs using the methods outlined in this book. The book's full-color layout and large format (8" x 10") make Sexy Web Design a pleasure to read. Master key web interface design principles Design amazing web interfaces from scratch Create beautiful, yet functional, web sites Unleash your artistic talents And much more Who should read this book? Whether you're completely new to web design, a seasoned pro looking for inspiration, or a developer wanting to improve your sites' aesthetics, there's something for everyone here. How? Because instead of trying to cover every possible area of creating a web site, we've focused purely on the design stage; that is, everything that happens before a single line of code is written. However, great design is more than just aesthetics. Long before we open our graphics program of choice, we'll be conducting research, dealing with clients, responding to briefs, sketching out sitemaps, planning information architecture, moving from doodles to diagrams, exploring different ways of interactivity, and building upon design traditions. But ultimately, you'll be finding out how to create web sites that look drop-dead gorgeous.
